EU AI Act Infrastructure Guide: What Every Enterprise AI Team Needs to Build

The EU AI Act is the world's first comprehensive AI regulation. Here's the complete infrastructure engineering guide for enterprises deploying AI in Europe.

Luca Berton9 min read

The EU AI Act (Regulation 2024/1689) creates a risk-based framework for AI systems. Prohibited practices are already banned (since February 2025). High-risk AI system obligations for standalone use cases (Annex III) apply from 2 December 2027, after the EU's 2026 Digital Omnibus postponed the original August 2026 date; AI embedded in regulated products (Annex I) follows in August 2028. For infrastructure teams, this is still the most significant AI regulation globally — and your systems must be ready.

Risk Classification and Infrastructure Impact

  • Unacceptable risk (Prohibited) — Social scoring, subliminal manipulation, real-time remote biometric identification in public spaces (with exceptions). Infrastructure action: detection and blocking mechanisms
  • High risk (Annex III) — Credit scoring, hiring, medical devices, critical infrastructure, education. Infrastructure action: full compliance stack required
  • Limited risk — Chatbots, deepfakes, emotion recognition. Infrastructure action: transparency mechanisms (disclosure that user is interacting with AI)
  • Minimal risk — Spam filters, AI in games. Infrastructure action: voluntary codes of conduct

High-Risk AI Infrastructure Requirements

Articles 8-15 define requirements that translate directly into infrastructure capabilities:

  • Risk management system → Continuous risk assessment pipeline integrated with MLOps
  • Data governance → Data quality validation, bias detection, lineage tracking
  • Technical documentation → Auto-generated model cards, experiment logs, architecture docs
  • Record-keeping → Immutable logging of all AI system events
  • Transparency → Explainability infrastructure, user-facing AI disclosures
  • Human oversight → Human-in-the-loop interfaces, kill switches, override mechanisms
  • Accuracy, robustness, cybersecurity → Continuous monitoring, adversarial testing, security hardening

Timeline for Infrastructure Readiness

  • February 2025 — Prohibited practices banned. Ensure no prohibited AI systems in your infrastructure
  • August 2025 — GPAI obligations apply. If you use foundation models, transparency and copyright compliance required
  • December 2027 — High-risk obligations apply for Annex III use cases, postponed from the original August 2026 date by the EU's 2026 Digital Omnibus. Full infrastructure stack must be operational

Start Now

December 2027 sounds far away, but the extension isn't an exemption. Building the governance platform, data quality infrastructure, monitoring systems, and human oversight mechanisms still takes 12-18 months. Start with an AI system inventory and risk classification — then build the infrastructure each risk tier requires.
